Hello, my name is Curtis Morrison. I work for Morrison Urena L.C., an immigration law firm based in California. In this video, I talk about updates in the DV-2022 group lawsuit that we just filed on May 17th. First, the short name for the lawsuit is: United African Organization v. Biden. Let us talk about that. The reason for the short name is that United African Organization is the first plaintiff on our list of plaintiffs and President Joe Biden is the first defendant in the list of government defendants. United African Organization - UAO for short is an organizational plaintiff. UAO is a dynamic coalition of African community-based organizations that promote social and economic justice, civic participation and empowerment of African immigrants and refugees in Illinois. The Diversity Visa lottery program is responsible for the largest percentage of African and black immigration to the United States. In fact, 133 of the DV families in this lawsuit say they plan to settle in in Illinois, where UAO is located.
So UAO is in Illinois - 133 families in this lawsuit are moving to Illinois, so when the Biden administration prioritizes other visa categories above DV winners, the impact is a sharp decline in African immigration to the U.S. In short, African immigration is important to UAO, that is why this lawsuit is important for UAO and why UAO is joining the DV selectees and their families as a co-plaintiff in this lawsuit.
We are grateful for their involvement. Second, we filed the lawsuit in federal court in Chicago, Illinois. Let us talk about that. UAO is in Chicago, also the law is favorable to our claims in what is called the seventh circuit - that's the federal circuit where Chicago is located. The law is on our side there. Third, let's talk about our judges' assignment. The UAO v Biden lawsuit has been assigned to judge Edmund Chang. Judge Chang has a reputation as a fair judge and we are happy with this assignment. He was nominated to be a federal judge by President Obama and he became a federal judge in 2010. Judge Chang was born in New York to parents who were immigrated from Taiwan. Fourth,
Let's talk about what is next in the lawsuit. Now we have filed a lawsuit electronically online. We must serve physical paper copies on the government defendants and their lawyers. This process is already underway and we hope it will be completed in about a week. Next, we plan to file a motion for preliminary injunction. This allows us to skip in line at the court and get relief earlier than in a traditional lawsuit due to the likelihood of imminent injury related to the upcoming September 30th deadline. If you were one of the plaintiffs who worked with Rosanna in getting us a declaration, that declaration will be an important exhibit to this motion for preliminary injunction.
After we file that motion we plan to follow what is called a motion for expedited discovery. The goal of that motion is to get evidence we can use to show Judge Chang why we need relief while we deserve relief. Specifically, we know we want evidence already collected in another DV-2022 lawsuit filed in Kentucky where a judge granted the government what is called a "protective order", to keep that evidence from becoming public. We think it is only fair the evidence provided by the government for DV-2022 plaintiffs in that lawsuit in Kentucky should be available for DV 2022 plaintiffs in UAO v Biden, too.
Fifth, a frequently asked question that we receive now from DV 2022 selectees who did not register to participate in this group lawsuit is whether they can be added to the group lawsuit. Now, the answer is no. We would need to stop the train, and back it up, and that would not be fair to our existing plaintiffs who are already in a hurry to get to the next train station! However, if you go to our website, there is a "waitlist" where you can sign up to be notified if we offer another group lawsuit for 2022 selectees. That is not our focus right now our focus right now is moving forward with the lawsuit that we just filed.
