In the process of DV winners, the winners of 2020 cannot be forgotten. Because Judge Mehta's final decision to proceed with the 9095 reserved visa process is eagerly awaited by the rest of the DV 2020 winners. In this context, there is confusion as to who will benefit from the 9095 reserve visa. Many DV 2020 winners had received second letters (2NLs), some did not, but many were documentarily qualified for the process and some did not even receive a document received notification from KCC. But the confusion is compounded by Judge Mehta's statement that a visa can be issued randomly because the reserve cases are under a class action of Gomez Vs. Trump litigation.
According to the DV Lottery Charts, 3548 case numbers for DV
2020 are in READY mode from all over the world, with 7181 applicants (with
derivatives). In the case of Nepal, 191 DV 2020 cases are in READT mode, with
331 applicants (with derivatives).
The DV 2020 process, which was suspended in March due to
President Trump's immigration ban in 2020, was simultaneously ordered by the US court on September 4 to issue a DV 2020 visa to the State Department on apriority basis. According to the priority, there were 4 types of categories.
The Department
of State will use the following prioritization plan for these applicants,
consistent with the court order and applicable law:
- Individuals who were named plaintiffs in Gomez v. Trump and its companion cases;
- Applicants who had already been interviewed who seek reassurance or to overcome a prior refusal;
- Applicants who were scheduled for appointments in March, April, or May and whose appointments were canceled due to the COVID-19 pandemic and worldwide suspension of routine visa processing;
- For posts that have additional capacity to process applications and are not exhausted by the three categories above, applicants whose cases are pending with the Department’s Kentucky Consular Center.
Based on this priority, applicants of the first and second
category are benefited in large numbers while third category applicants
benefited in very small numbers. However, it has not been confirmed that the
fourth category applicants have received visas. In this sense, the current 9095
reserve visa should benefit the third and fourth category applicants to a
greater extent. However, due to the lack of an official decision from the
court, it is not clear whether the visa will be issued on a priority basis or
on what basis.
However, the winners of DV 2020 are hopeful that the process
of 9095 reserve cases will move forward sooner or later due to the recent
decision of Judge Mehta. However, no decision has been made on the time frame
for the winners of DV 2020 to proceed with the rest of the process.
