Gomez Case Update – Government Files Motion for Stay (Summarized in Nepali)

Dear Gomez Diversity Class Members,

You are receiving this email from counsel in Gomez v. Biden because you responded to a call for plaintiffs from BritSimonSays.com or contacted us directly as a DV-2020 selectee and/or an individual acting on their behalf. If you are an FY2020 Diversity Visa Selectee who did not receive a diversity visa on or before April 23, 2020, because of Proclamation 10014, you are a class member in the certified Gomez class.

We are writing to provide an update on the Gomez case and recent developments that may affect the class.

On February 1, 2022, the government filed a motion for a stay of Judge Mehta’s October 13, 2021, final order granting relief to the Gomez class. A “stay” is a court order that would temporarily pause the relief ordered by Judge Mehta while the government pursues its appeal. The government has asked the court to rule on its request by February 15, 2022, and stated that it will make the same request of the appeals court if the district court has not made a decision by that date.  

If the government’s request for a stay (or pause) is granted, the government will (temporarily) no longer be obligated to make efforts to begin issuing the reserved 9,095 visas to the Gomez class, nor will it be bound by the September 30, 2022 deadline for the issuance of the reserved 9,095 visas. The government would also (temporarily) no longer be obligated to update the court every 60 days on its progress. The stay (or pause) would likely remain in place until the government’s appeal is resolved unless the court orders otherwise.  

If the request for a stay (or pause) is denied, during its appeal the government will remain obligated to begin visa processing, to process all reserved visas by September 30, 2022, and to provide the court with updates on its progress every 60 days, with the next update due on March 14, 2022. However, the outcome of the government’s appeal may change or eliminate the relief ordered by Judge Mehta altogether.  

We oppose the government’s request to temporarily pause the judge’s final order while they pursue an appeal, and will be filing a written opposition to their request with the court. We can only imagine that this attempt to further delay visa issuance causes challenges for you and your families; please know that, despite the government’s efforts, we will do all that we can to make sure that the reserved 9,095 visas remain available to class members and are issued as quickly as possible.

डिभी २०२० अन्तर्गतका ९०९५ रिजर्भ भिसाको बारेमा बुझ्नुपर्ने तथ्यहरु (फेब्रुअरी ४ मा अपडेट गरिएको)

👉 गत १ फेब्रुअरी २०२२ मा सरकारी वकिलहरुले १३ अक्टोबरमा न्यायधीश मेहताले गोमेज क्लास सदस्यहरुको पक्षमा गरेको फैसलालाई रोक्न (वा विरुद्धमा) मुद्धा (अपिल) दायर गरे । सरकारी वकिलहरुको तर्फबाट आएको मुद्धाको कारणले न्यायधीश मेहताको पहिलाको फैसलालाई यसले अस्थायी रुपमा असर गर्नेछ । सरकारले अदालतलाई १५ फेब्रुअरी २०२२ मा यस विषमा फैसला गर्न अनुरोध गरेको छ । अर्को अर्थमा अदालतले अर्को सुनुवाई वा फैसला नगरेसम्म न्यायधीश मेहताको फैसलालाई कार्यन्वायन गर्न रोकिनेछ । 

👉 यसको मतलब ९०९५ रिजर्भ डिभी २०२० का केसहरुले भिसा पाउने प्रक्रिया हाललाई रोकिएको छ । नत्र यस भन्दा अघिको न्याधीशको फैसला अनुसार आगामी ३० सेप्टेम्बर २०२२ सम्ममा रिजर्भ भिसालाई जारी गर्ने र प्रत्येक ६० दिनमा के कति भिसा जारी भयो भनेर अदालतलाई प्रतिवेदन दिनुपर्ने थियो । जुन कुरा डिपार्टमेन्ट अफ स्टेटले विविध सिस्टमहरुको अध्यावधिक गर्नुपर्ने भएकोले अप्रिल पहिलो हप्तोदेखिमात्र रिजर्भ भिसाहरुको सन्दर्भमा काम गर्न सकिने सूचना जारी गरेको थियो । तर, अहिले ती सबै कामहरु ठप्प भएका छन् । जसको कारणले सेप्टेम्बर सम्ममा रिजर्भ भिसा जारी गर्नुपर्ने र हरेक ६० दिनभित्रमा अपडेट दिनुपर्ने काममा सरकार वा डिपार्टमेन्ट अफ स्टेट बाध्य हुनेछैन । 

👉 यदि यो अपिललाई अदालतले इन्कार ग¥यो वा यसको विपक्षमा फैसला ग¥यो भने सेप्टेम्बर ३० भित्रमा रिजर्भ भिसा जारी गर्नुपर्ने र हरेक ६० दिनभित्रमा अपडेट दिनुपर्ने न्यायधीश मेहताको फैसला यथावत रहनेछ । यो फैसलाको लागि १५ फेब्रुअरी २०२२ सम्म कुनुपर्ने हुनसक्छ वा अझै लम्बिन पनि सक्छ । समग्रमा यो बुझिन्छ कि यो पुनः फैसला नहुन्जेजसम्मलाई डिभी २०२० को रिजर्भ भिसाको प्रक्रिया रोकिएको छ । 

👉 भयानक कुरा यो छ कि, यस अपिलले न्यायधीश मेहताको फैसलालाई परिवर्तन वा पूर्ण रुपमा खारेज गर्न पनि सक्नेछ । यदि यस अपिलको पक्षमा फैसला भयो भने डिभी २०२० अन्तर्गत रिजर्भ गरिएका ९०९५ भिसाहरुको अन्तिम आशा लगभग समाप्त भयो भन्ने निष्कर्षमा पुग्न सकिन्छ ।

The Case numbers in the READY mode of Nepali DV 2020 winners (12 September 2021)

In the process of DV winners, the winners of 2020 cannot be forgotten. Because Judge Mehta's final decision to proceed with the 9095 reserved visa process is eagerly awaited by the rest of the DV 2020 winners. In this context, there is confusion as to who will benefit from the 9095 reserve visa.
